On September 23, 2026, OSHA's Atlanta regional office announced a willful citation against T & T Pipeline Co. Inc., an Orlando-based pipeline installation contractor, after a worker was killed at a New Smyrna Beach worksite on March 17 (OSHA, 2026). The agency proposed $165,514 in penalties (OSHA, 2026). That figure is the statutory ceiling. The workers' comp claim generated by the same death carries no ceiling, and it will still be pricing this company's insurance in 2030.

That asymmetry is the whole story for utility and pipeline contractors. The fine is the smaller half of the bill.

The OSHA willful violation penalty is the smaller bill

A willful or repeated violation tops out at $165,514 per violation, and serious and other-than-serious violations cap at $16,550 each (OSHA, 2026). Those are the 2025 amounts carried forward: OSHA made no inflation adjustment for 2026 because the October 2025 CPI data it needed was never published. Either way the structure is statutory. Congress wrote a maximum into the OSH Act, and no fact pattern, however bad, pushes past it. OSHA proposed the maximum here.

According to the release, employees were replacing a drill bit on a horizontal drilling machine when the pipe stem began to rotate and fatally struck a worker (OSHA, 2026). OSHA cited one willful violation for exposing employees to struck-by hazards on a horizontal directional drilling (HDD) machine. A willful classification means OSHA concluded the employer knowingly failed to comply or acted with plain indifference to worker safety, and that finding follows the company into every future inspection file.

The reporting clock runs alongside the fine. Under 29 CFR 1904.39, a work-related death must reach OSHA within eight hours, and an in-patient hospitalization, amputation, or loss of an eye within 24 (OSHA, 2026). The same event that starts the OSHA investigation starts the comp claim.

The claim that outlives the citation

Here is where the two systems split. The experience modification rate compares a contractor's actual losses with expected losses for its classifications and payroll, and each mod draws on three policy years of claims, skipping the most recent completed year (NCCI, 2026). On a calendar-year policy, a March 2026 death first prices the 2028 mod and keeps pricing through 2030. The fine is paid once. The claim bills for three years.

A fatality is pure severity. The split point discounts the excess portion of a large claim, but it does not erase it: the primary layer counts in full and the excess still enters at its weight. For illustration, take a pipeline contractor paying $150,000 in manual premium whose mod moves from 1.00 to 1.35 after the claim. That is $52,500 a year, roughly $157,500 across the three rating years the claim occupies, before the claim's own cost works through the loss pool. Florida is federal ground

Florida has no OSHA-approved State Plan, so federal OSHA inspected this fatality and set this penalty. There are 22 State Plans covering private employers, including North Carolina, South Carolina, and Tennessee (OSHA, 2026). Southeast contractors cross federal and state-plan lines constantly. The comp consequences follow the payroll either way.

Drill-bit changes are routine work on a directional bore, which is why a willful finding on one carries weight beyond a single site. The comp claim has no such window.
